Business Associates Agreements

Business Associates Agreement

The purpose of a Business Associate Agreement is to make your vendors with access to your PHI aware of the requirements for the use and protection of that information. Failure to take adequate steps in this area can result in serious financial consequences. This is an area quite often overlooked, despite the fact that it presents a large amount of risk to your practice or business.

Key Highlights of BAA

  • Inform Associate of the Privacy requirements of PHI
  • Outline the allowable use by Associate
  • Define protection and misuse requirements
  • Define breach of contract and cure process
  • Define termination of agreement
  • Define required insurance liability requirements and proof
Below is a link to download a BAA with minimal requirements. It is suggested that you have this reviewed with your legal counsel. Some organizations have more burdensome agreements.
